1. About the Terms of Purchase

These Terms of Purchase (“Terms of Purchase”) apply to all purchases that you as a consumer make from www.saunaice.com and related websites (“Website”) . You accept the Terms of Purchase in connection with making a purchase on the Website.

The agreement is concluded with Bolsaj AB (Sauna Ice), corporate registration number 559425-2479 and address Nordöstra Vägen 9, 981 92 Kiruna ( “Bolsaj”, “us” or “we” ).

2. Orders

We only sell to customers who are acting as private individuals (consumers). To make a purchase, you must have the right to enter into a contract under applicable law. This means that you must be at least 16 years old to make a purchase with direct payment using your own money or at least 18 years old to make a purchase on credit.


3. Order and delivery confirmation

Once you have completed your purchase, you will receive an automatic delivery confirmation via email, confirming that we have received your order. This automatic confirmation means that we will package and ship your order. And that a binding contract has been entered into.


4. Prices and information

When ordering, the prices stated on the Website at the time of ordering apply. Our prices on saunaice.com are stated in Swedish kronor. All prices include applicable VAT but do not include any payment and shipping fees, which are stated separately.


4.2
If the price or information about a product stated on the Website is incorrect and you realised or should have realised this, the price or information will not apply to the purchase even if you have received a delivery confirmation. In such cases, we will contact you as soon as possible.


4.3
Product images on the Website are for illustration purposes only and the actual product may vary slightly. We cannot guarantee that all images accurately reflect the appearance of the product, for example due to monitor screen differences that may affect color reproduction.


5. Payment

We offer different payment options and you can choose which payment option you want to use. The possible payment options that you can choose from are always shown in the checkout on the Website and in connection with your order. Depending on which option you choose, additional costs may apply and information about this is available in connection with the order in the checkout.

When you make a purchase with us, you will enter into a separate payment agreement with our payment service provider.


6. Shipping and delivery

We offer different delivery options depending on which products are to be sent where. The delivery options we offer are always shown at checkout on the Website. We offer home delivery depending on where you live.

To make delivery easier for you as a customer and to minimize environmental impact, we always try to deliver your products in one delivery.

These terms and conditions apply to deliveries within Sweden. Please note that we do not deliver to Åland.

Depending on the products you purchase, the shipping option you choose, and the total amount of your order, shipping fees may apply. The shipping fee is always displayed at checkout during your purchase.

Delivery time

The expected delivery date is stated on the Website. We always aim to deliver your order within the estimated delivery time stated on the Website, but this is not guaranteed.


Unclaimed packages

You are responsible for receiving or collecting your delivery in accordance with the instructions you receive when ordering.

Packages at post offices that are not picked up within the time specified on the avin will be sent back to us. If you have chosen home delivery and do not follow the instructions for receipt, for example, are not at home to receive your delivery, the package will be sent back to us.

In these cases, we have the right to charge an administrative fee that corresponds to our costs for handling and shipping.


7. Right of withdrawal, open purchase and 100% customer satisfaction guarantee


7.1
In addition to the statutory right of complaint and withdrawal, we offer a “100% satisfaction guarantee”. This means that a customer has the opportunity to test the product for up to one week after the first delivery. If the customer is not satisfied with the product for any reason, we will refund the full price of the product including delivery costs, provided that the customer returns the remaining product within 21 days. The customer then only pays the shipping cost for the return of the product. The “100% satisfaction guarantee” only applies to the first delivery and can only be used once per person. You have the right to cancel your purchase within 14 days from the day you, or a person on your behalf, receives the product you have purchased on the Website.


How to cancel your purchase/open purchase

If you wish to cancel your purchase, you must notify us within 14 days from the day on which you, or a person on your behalf, receives or collects your order.


7.4
After you have notified us that you wish to return your purchase, you need to send or return the product within 14 days from the day on which you, or a person on your behalf, receives or collects your order. We recommend that you return the product in the same packaging in which you received it, as you are responsible for any damage or loss during return shipping, if the damage or loss is caused by your negligence, for example when packaging the product.

Return shipping

You are responsible for the return shipping. The cost of return shipping when you choose to return through us will be deducted from your refund. You can find information about our return shipping costs.


Refund

Once you have returned your purchase, we will process your refund through our payment service provider within 14 days. However, we will not issue the refund until we have received the product back. Please note that you are responsible for any damage or loss during return shipping that is due to your negligence.

When returning an entire order, the refund includes any shipping costs (for shipping to you) that you paid in connection with the purchase.

If you return part of an order, shipping will not be refunded.

The refund will be made using the same payment method you chose when purchasing, unless we agree otherwise.


8. Complaints


8.1
If there is a defect in your product, you have the right to complain about the defective product in accordance with the mandatory consumer protection legislation in force in the country where you are staying. You have the right to complain about original defects in the product that arise within three years from the delivery of the product (the liability period). You always need to complain within a reasonable time from when you should have noticed the defect. Your right to complain ceases after the three-year liability period has passed.

Once the product complained about has been assessed and we have determined that the complaint is valid, we will compensate you in accordance with applicable law. This means that the defect will be rectified or that we will replace the faulty product with a new one. If neither of these options is possible, you have the right to demand a price reduction corresponding to the defect or cancel the purchase in accordance with applicable law.

Please note that we have the right to refuse a complaint if it turns out that the product is not defective according to applicable law.

9. Offers


9.1
We may from time to time offer promotions, discount codes, gifts and other offers (collectively referred to as “offers” below). Such offers are only valid for the period specified in connection with such offer and with the terms and conditions specified in connection with the offer. The promotional period cannot be extended and if the stock is sold out during the promotion, alternative replacement products will not be offered instead. Offers cannot be combined with other discounts or offers, unless expressly stated in connection with your purchase.


9.2
In many cases, you may need to actively enter any code or otherwise activate the current offer before completing the purchase in order to take advantage of the offer.


9.3
If you return ordered products, it may mean that you no longer meet the terms and conditions of the offer. This may mean that you need to return or pay for any gift or can no longer keep a certain discount. If, due to a return, you no longer meet the terms and conditions of the gift in question and do not return the gift, we will deduct the value from the gift before issuing your refund. Alternatively, if you do not meet the terms and conditions of a certain discount, it will be deducted from the refund.


10. Fair Practice Policy

To shop with us you must:

  • you are not attempting to commit fraud or otherwise acting with intent to violate applicable laws;
  • you do not attempt to mislead us regarding your identity or falsely represent yourself as a consumer in order to shop with us;
  • you do not exert undue pressure or threaten our staff in contact with our customer service,
  • you have an intention to keep the products you order. This does not prevent you from subsequently changing your mind. You are always entitled to your statutory right of withdrawal and open purchase according to our Terms and Conditions.


10.2
Behaviors that are considered to violate this Fair Practice Policy include, for example, the following:

  • Fraud attempts in connection with returns, such as changing/forging labels and price tags and false claims of lost products,
  • to falsely claim to be a consumer in order to shop with us but then, for example, market or resell the products within the framework of a business activity,
  • purchasing products to photograph them in business and then mistakenly returning the products with reference to the right of withdrawal or open purchase which only applies to consumers,
  • attempts to exert undue influence or threaten our staff in order to obtain an extended right of return compared to our terms of purchase or mandatory law, and
  • Very abnormal purchasing and return behavior that shows that the customer previously had no intention of keeping ordered products.


10.3
Our assessment of whether you are violating our Fair Practice policy is based on a number of different factors such as systematically deviating behaviors, order composition, order frequency, return frequency, and attempts at circumvention with false identity.


10.4
If your order is refused, you will be informed of this via an email sent to the email address you provided when placing the order. Once we have notified you that we have refused to sell to us, the decision applies to you regardless of your profile or email address. It is not permitted to try to circumvent this decision in any way, for example by trading in someone else's name, as such misleading behaviour in itself constitutes a breach of the Fair Practice policy.


10.5
Our Fair Practice Policy does not prevent you from exercising your statutory right of withdrawal or 14-day right of withdrawal when you have made a binding purchase with us. However, our Fair Practice Policy may in specific cases prevent you from entering into a new contract with us.


11. Our obligations


11.1
If there is a defect in your product or if delivery is delayed, we are liable for damages that you have suffered due to the defect or delay, in accordance with mandatory consumer protection legislation. However, we are only liable for damages to the extent that you have taken reasonable measures to limit your damage. We are therefore not liable for damages that you could have avoided by taking reasonable measures.


11.2
We are not liable for damages caused by unforeseen circumstances beyond our control, such as war, strike, pandemic or natural disasters, which we could not reasonably have foreseen (Force Majeure). If we are prevented from fulfilling our obligations under the contract or these Terms and Conditions due to Force Majeure, you have the right to withdraw from the contract in accordance with mandatory consumer law.


12. About these Terms and Conditions


12.1
We may change these Terms of Purchase, but the Terms of Purchase that you accepted at the time of your purchase will always apply to that purchase. Any changes will be reflected in the most recently published version of the Terms of Purchase on the Website. Changes will take effect from the time you have accepted the Terms of Purchase, i.e. when you make a new purchase on the Website.

It is important to us to respect your rights as a consumer. As a company based in Sweden, these Terms and Conditions shall be interpreted and applied in accordance with Swedish law. If any provision of these Terms and Conditions is held to be invalid or unenforceable by any competent court, authority or alternative dispute resolution body, the remaining parts of that provision and all other provisions of these Terms and Conditions shall remain valid and enforceable to the fullest extent permitted by applicable law. You are always entitled to the mandatory consumer rights that apply in the country where you have your habitual residence. Nothing in these Terms and Conditions shall be construed as a limitation of such rights.

In the event of a dispute with private individuals, we will follow the decisions of alternative dispute resolution bodies. To access the alternative dispute resolution body in Sweden, you can contact the Swedish National Complaints Board (ARN), www.ARN.se. You can contact ARN by sending a letter to Box 174, 101 23 Stockholm.

As a private individual, you also have the opportunity to complain via the EU's online dispute resolution platform, which you can find here.


13.4
Notwithstanding the above, any disputes may also be resolved in any competent court in the country where you as a customer are domiciled.
